These Terms of Service ("Terms") govern your access to and use of the pAIq platform operated by PAIQ RAAS, S.L. ("pAIq", "we", "us", "our"), a company incorporated in Málaga, Spain.
By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.
1. The Service
pAIq provides an AI-powered platform that connects to your Instagram account and automates responses to direct messages ("DMs") on your behalf. The service is accessed via a web dashboard at paiq.io.
We provide the service on a subscription basis. Features and limits vary by plan (Starter, Pro, Business).
2. Eligibility
You must be at least 18 years old to use pAIq. By using the service, you represent that you meet this requirement and have the authority to enter into a binding agreement.
3. Account Registration
You must provide accurate, complete information when registering. You are responsible for maintaining the security of your account credentials. Notify us immediately at hello@paiq.io if you suspect unauthorised access.
We reserve the right to suspend or terminate accounts that provide false information.
4. Subscriptions and Billing
Subscription plans:
- Starter: €49/month — 1 Instagram account, 1,000 DMs/month
- Pro: €99/month — 2 accounts, unlimited DMs
- Business: €199/month — 5 accounts, unlimited DMs + white-label
Free trial: All new accounts receive a 14-day free trial. No credit card is required to start. At the end of the trial, a payment method must be provided to continue using the service.
Billing: Subscriptions are billed monthly via Stripe. Your subscription renews automatically on the same date each month unless cancelled.
Refunds: We do not offer refunds after a billing period has started. If you cancel before the next billing date, you retain access until the end of the current period.
Price changes: We will notify you at least 30 days in advance of any price changes. Continued use after the effective date constitutes acceptance.
5. Acceptable Use
You agree not to use pAIq to:
- Send spam, unsolicited messages, or misleading content
- Impersonate other people or entities
- Violate any applicable law or regulation
- Harass, abuse, or harm others
- Scrape data or attempt to gain unauthorised access to the platform or third-party systems
- Circumvent technical restrictions or security measures
pAIq reserves the right to suspend or terminate your account for violations of this section without refund.
6. Instagram API Compliance
pAIq uses the Meta (Instagram) API to deliver its service. By using pAIq, you agree to comply with:
You are solely responsible for ensuring your use of pAIq complies with Meta's platform policies. pAIq does not guarantee continued access to the Instagram API and is not liable for any disruption caused by changes to Meta's API or policies.
7. Intellectual Property
All content, code, design, and branding on the pAIq platform is owned by PAIQ RAAS, S.L. and protected by applicable intellectual property laws.
You retain ownership of all content you provide, including your DM history and AI training inputs. By using the service, you grant us a limited licence to process that content for the purpose of delivering the service.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- pAIq is not liable for any indirect, incidental, special, or consequential damages
- Our total liability to you in any month shall not exceed the subscription fees paid by you in that month
- We do not guarantee that the service will be uninterrupted, error-free, or always available
The service is provided "as is" without warranties of any kind, express or implied.
9. Cancellation
You may cancel your subscription at any time via your account dashboard or by emailing hello@paiq.io. Cancellation takes effect at the end of the current billing period. No partial refunds are issued.
We may cancel or suspend your account if you violate these Terms, with or without notice.
10. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will provide reasonable notice of significant changes where possible.
11. Governing Law and Disputes
These Terms are governed by the laws of Spain. Any disputes shall be submitted to the competent courts of Málaga, Spain, unless applicable consumer protection law requires otherwise.
